The text of the Code states that Local planning authorities should encourage applicants to apply principles representing sustainable and environmentally friendly design and constructions regarding new developments (Office of the Deputy Prime Minister, 2005, p. 18). Paragraph 39 also states that the local planning authorities should encourage applicants to apply the Code for Sustainable Homes representing strategic sites that deliver a large number of new homes (Office of the Deputy Prime Minister, 2005, p. 18). The strength of the Code is thus effectively weakened through the use of the word ‘encourage' as opposed to ‘require', an observation that has been made by the Friends of the Earth (2006).
