Principle 7 binds the agreeing nations to conserve, protect and restore the health and integrity of the Earth's ecosystem and under Principle 8 that nations should reduce and eliminate unsustainable patterns representing consumption along with production and promote appropriate demographic policies (United Nations General Assembly, 1992). The ‘Declaration' under Principle 11 states that nations shall enact effective environmental legislation standards, management objectives ... and that such should be appropriate within the context and spirit of the ‘Declaration'(United Nations General Assembly, 1992).
The foregoing understanding of the manner in which the sustainable development initiative came into being is important in reading into the context of legislative action, and rules enacted in the United Kingdom. The United Nations Declaration clearly indicates the importance of implementing sustainable development in consort with environment, consumption and production measures to limit and reverse the impacts of human activity on the Earth's ecosystem. The legislation enacted by the United Kingdom seemingly falls short of the preceding as indicated by the mentioned analysis of the Code for Sustainable Homes and Planning Policy Statement 3 (PPS) by the Friends of the Earth (2006). The foregoing was critical of the strength of the legislation that provided what they termed as weak incentives for Local Authorities to enact utilization of the Code. The legislation indicates that it is geared to large strategic sites rather than individual homes. This represents a barrier in the implementation of the building of sustainable homes on a mass basis as developers and builders are not required to implement the features and benefits in all houses being constructed. That opening in the legislation effectively limits the application of the concept, slowing utilization through the specification that permits developers and builders to circumvent the investment in new construction plans, processes, features, materials and equipment. The Friends of the Earth (2006) review also pointed out the use of the word ‘encourage' as opposed to ‘require' in the verbiage weakens the strength of the Code.
These aspects represent critical barriers to the application of the United Nations mandate in the United Kingdom regarding the timely change over to housing that incorporates sustainable and environmental enhanced features. In concept, the foregoing means that developers and builders have no reason to pursue massive the application of energy, environmental and ecological benefits when other developers and builders can produce comparable homes, in terms of size, at a lower cost.
