A general duty to co-operate and communicate has been imposed upon these actors, but more specific duties have been placed upon the other identified stakeholders such as the clients, designers, contractors, subcontractors, the planning supervisor and the principal contractor (although this is not an exhaustive list). Another general duty imposed is that only stakeholders who are competent and adequately resourced may be appointed to the various roles to which the CDM regulations ascribe particular standards and protocols.
Aims and purpose
The aims and purpose of this project are perhaps difficult to separate, or to extrapolate. Perhaps, however, it is easier to discuss the purpose of the project in broader terms. The purpose of the project is to gain a more in-depth, comprehensive knowledge of the impact that the CDM regulations have had upon the construction industry, and to use this understanding to explain and discuss the effects which the CDM regulations have had upon accident statistics in the UK.
This is a dynamic area and the intersections between law and the construction industry are becoming more and more pertinent to the day to day management of a construction project (Health and Safety Executive (2003) 1-5) (HSE (2007) 1-3) (Ackroyd, S. and Fleetwood, S. (2000) Ch. 1) (Anson, M. (2003) 1-5). Therefore, achieving a more in depth, and comprehensive understanding of this area is perhaps the definitive purpose of the project.
The aims of the project are smaller scale initiatives which will attempt to satisfy the overall purpose of the project in aggregate terms. There are therefore, several aims. As a preliminary matter, it is an aim of the project to assimilate all of the necessary research materials and to aggregate original, primary research with more established secondary research sources and materials.
In doing so, it is anticipated that some individuals connected with the construction industry will be interviewed and their views on the success or failure of the CDM regulations on the construction industry. It is anticipated that these views will be assessed in conjunction with valid information gathered in relation to the CDM regulations and how they have developed within the UK in recent years. There will also be an assessment of how the CDM regulations could be improved upon, and how the project has contributed to this assessment. The overall aim of the project is to produce a coherent document which catalogues, in detail the impacts which the CDM regulations have had upon the construction industry and which encapsulates some original, primary research.
